Scope of application
These General Terms and Conditions (GTC) apply to all contracts via the Emotion Ride GmbH online store between Emotion Ride GmbH and its customers.

These GTC apply exclusively to contracts concluded via the online store.
They expressly do not apply to:
- Workshop services
- Installation work
- Services
- On-site sales in the store or in the workshop
Separate agreements apply to these services.
A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that cannot be attributed primarily to their commercial or independent professional activity.

Conclusion of contract
The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding invitation to order.
By clicking on the order button, the customer places a binding order for the goods contained in the shopping cart.
The purchase contract is concluded as soon as the seller accepts the order by sending a confirmation by e-mail.
Prices and shipping costs
All prices in the online store are in euros and include VAT.
Shipping costs may apply in addition to the prices stated. These are shown separately in the order process.

Shipping
Delivery is worldwide.
Shipping is carried out exclusively via DHL.
The delivery time is specified on the respective product page.
If an ordered product is not available, the customer will be informed immediately.
Terms of payment
The following payment methods are available in the online store:

- Apple Pay
- Google Pay
- Bank transfer (prepayment)
The available payment methods may be restricted in individual cases.
If the payment method prepayment is selected, the goods will only be dispatched after receipt of payment.
Retention of title
The goods remain the property of Emotion Ride GmbH until full payment has been received.
Warranty
The statutory warranty rights apply.
Liability
The seller's liability for damages is excluded, unless otherwise specified below.
The seller is liable without limitation:
- in the event of intent or gross negligence
- in the event of injury to life, limb or health
- in accordance with the provisions of the Product Liability Act
Products for motor vehicles
Some of the products offered are intended for installation in motor vehicles.
Installation and use are always at the customer's own risk.
The seller accepts no liability for damage caused by improper installation or improper use.
The customer is responsible for checking whether the use of the products is permitted on public roads.
Customized software products
Some products in the online store relate to software solutions for engine control units or electronic vehicle functions.
These products are created individually for the respective customer, in particular on the basis of vehicle-specific data such as:
- Vehicle identification number (VIN)
- Vehicle model and year of manufacture
- Vehicle configuration
- Technical equipment or modifications
Due to this individual production, these are products that are not prefabricated.
There is no right of withdrawal for such customized products in accordance with §312g Para.2 No.1 BGB.
Applicable law
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
